When it comes to the Subclass 482 Temporary Skills Shortage visa, 112 of the occupations listed have caveats attached which may affect some applicants.
What is a caveat?
A caveat is a condition or additional requirement applied to a particular occupation. This occurs when an occupation is broad or difficult to define. They are designed to ensure that skilled visa programs are used to fill skilled positions that cannot be filled by the local labour market. Caveats identify more specific requirements within an occupation. They can also include conditions that relate to the business seeking to employ overseas workers for a particular occupation. If these requirements are not met it could result in a refusal of a visa and nomination application.
Caveats apply to all the occupation lists: short-term skilled occupation list, medium and long-term strategic skills list and the regional occupations list.
What occupations have caveats?
Caveats can apply to occupations in all industries including agriculture, retail, hospitality and professional services etc.
Here are some examples of how caveats are applied to some occupations.
Massage Therapist
Caveat no.12 applies to the occupation of massage therapist. The conditions that apply are as follows:
– The position must be full-time
– The position must be based in a therapeutic environment
– The position must not involve providing non-medical relaxation massages
– The position must not be in a retail environment
Chef
Caveats no.7 and no.8 apply to chefs. The conditions that apply are as follows:
– The position cannot be in a factory setting mass producing products
– The position cannot be in what is classed as a limited-service restaurant such as
o Fast food and take-away outlets
o Cafes and restaurants that don’t offer table service (order and pay at till), that are part of a chain or only offer a limited food menu
o Drinking venues with limited food offerings
Customer Service Manager
There are three caveats that apply to the occupation of customer service manager, these are caveat nos. 2, 11 and 19. The following conditions apply:
– The annual earnings for this position must be $65,000 (AUD) or more
– The position must not be based in an environment where goods are sold directly to the public, e.g.: in stores or involve directly selling or promoting products to clients on a regular basis
– The position must be for a business with an annual turnover of $1million (AUD)
